Terms of Service

Section 1 — Who We Are

Trading Ark ("Trading Ark," "we," "us," or "our") is an educational trading community that provides access to proprietary TradingView indicators, trading education, member signals for educational reference, and a members-only Discord community. Our website is located at thetradingark.com.

Section 2 — Acceptance of Terms

By accessing or using any Trading Ark service — including this website, our Discord server, our TradingView indicators, or any related content or communications — you ("you," "user," or "member") agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you must not access or use our services.

Your use of our services, your completion of our Discord verification process, or your purchase of a membership constitutes your acceptance of these Terms, which form a binding legal agreement between you and Trading Ark.

Section 3 — Description of Services

Trading Ark provides the following services to members:

Section 4 — Membership and Access

Membership is purchased through our third-party membership and payment platform, currently Whop. Upon successful payment and completion of our onboarding process:

Access is personal and non-transferable. You may not share, sell, gift, or otherwise transfer your membership, login credentials, Discord access, or TradingView indicator access to any third party under any circumstances.

Trading Ark reserves the right to verify the identity of users and to terminate access if we determine that credentials or access are being shared.

Section 5 — Acceptable Use

By accessing our services, you agree that you will NOT:

Violation of any of these prohibitions may result in immediate and permanent termination of your membership without refund and may expose you to legal liability.

Section 6 — Intellectual Property

All Trading Ark content — including but not limited to the Indicator, signal posts, educational materials, written content, graphics, logos, and all content posted by Trading Ark staff — is the exclusive intellectual property of Trading Ark. All rights are reserved.

Upon payment of your membership fee, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use our content solely for your own personal, non-commercial educational purposes during the period of your active membership.

This license expressly does not permit you to:

Section 7 — Anti-Piracy and Unauthorized Sharing

Unauthorized sharing, redistribution, or reproduction of Trading Ark indicators, signal calls, educational content, or any other proprietary material is strictly prohibited and constitutes a material breach of these Terms.

Such conduct may also constitute copyright infringement under the United States Copyright Act and other applicable intellectual property laws, exposing you to civil liability including statutory damages of up to $150,000 per work infringed.

Trading Ark actively monitors for unauthorized distribution of our content and reserves the right to pursue all available legal remedies against individuals who engage in piracy or unauthorized distribution, including claims for damages, injunctive relief, and recovery of attorneys' fees and costs.

Section 8 — Not Financial Advice

ALL CONTENT PROVIDED BY TRADING ARK IS FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY.

Nothing in any Trading Ark communication — including this website, our Discord server, signals, live sessions, indicator outputs, or any other content or communication — constitutes:

Trading Ark and its owners, staff, and contributors are not registered investment advisors, broker-dealers, commodity trading advisors, or licensed financial planners. Nothing we provide should be construed as professional financial guidance.

Section 9 — Risk Disclosure

Trading financial markets — including stocks, options, futures, forex, and cryptocurrencies — involves a high degree of risk, including the possible loss of all capital invested. You should never trade with money you cannot afford to lose.

Section 10 — Affiliate and Partner Disclosure

Trading Ark may maintain affiliate or referral relationships with third-party platforms, tools, or services. Where applicable, we may receive compensation when you purchase products or services using our referral links or codes. Such compensation does not influence our educational content or community operations. This section constitutes our affiliate disclosure.

Section 11 — Account Termination

Trading Ark reserves the right to suspend or permanently terminate your membership at any time, with or without prior notice, for reasons including but not limited to:

Upon termination, your access to all Trading Ark services — including the Discord server and TradingView indicator — will be revoked immediately. No refund will be issued upon termination for cause.

Section 12 — Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRADING ARK, ITS OWNERS, EMPLOYEES, INDEPENDENT CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE TO YOU FOR:

Section 13 — Refund and Payment Policy

All sales are final. No refunds will be issued once access to our Discord server or TradingView indicator has been granted, regardless of whether you have used the service. See our full Refund Policy at thetradingark.com/refund.

Filing a chargeback or payment dispute with your bank or payment provider constitutes a breach of these Terms and will result in immediate and permanent termination of your membership and may be pursued for the full disputed amount plus all associated fees and costs.

Section 14 — Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Ohio, and you hereby consent to the personal jurisdiction of such courts.

Section 16 — Changes to These Terms

Trading Ark reserves the right to update, modify, or replace any part of these Terms at any time at our sole discretion. Changes will be effective upon posting to this page with an updated Last Updated date. We may also notify members of material changes via Discord or email.

Your continued use of our services after any modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
